1. Agreement to Terms
By accessing or using the Shipzen website and services (collectively, the "Services"), you ("Customer," "You," "Your") agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Services. These Terms apply to all visitors, users, and others who access or use the Service provided by Shipzen ("Company," "We," "Us," "Our").
These Terms incorporate by reference our Privacy Policy, Shipping Policy, Refund Policy, Return Policy, and Prohibited Items Policy, all available on our website.
2. Definitions
- Services:Includes but is not limited to package receiving, storage, consolidation, repackaging, purchase assistance, international shipping facilitation, customs documentation assistance, and related services offered through our website and platform.
- Customer/You:The individual or entity registering for or using the Services.
- Company/We/Shipzen:The provider of the Services.
- Shipment:Goods or packages tendered to Us by You for the purpose of utilizing our Services.
- Merchant:The original seller or retailer from whom You purchase goods.
- Carrier:Third-party transportation companies (e.g., DHL, FedEx, UPS, postal services) engaged for the transport of Shipments.
3. Description of Services & Company Role
Shipzen provides shipping and logistics facilitation Services. We act as Your agent to receive, handle, and arrange transportation for Your Shipments via Carriers. We are not the end Carrier unless explicitly stated. Our responsibility is limited to the scope of Services agreed upon and paid for.
4. User Accounts
To use certain features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account. Shipzen cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of your account.
5. Customer Responsibilities and Warranties
By using the Services, You warrant and represent that:
- You have the legal right and authority to ship the items tendered to Us.
- You will comply with all applicable laws and regulations of the origin, transit, and destination countries, including customs, import/export, and security laws.
- All information provided to Us, including item descriptions, values, recipient details, and customs declarations, is accurate, complete, and truthful. You acknowledge that inaccurate declarations can lead to penalties, delays, or confiscation, for which You are solely responsible.
- The Shipment is properly and securely packed to withstand the ordinary risks of transit and handling.
- The Shipment does not contain any Prohibited Items as defined in our Prohibited Items Policy and by applicable laws or Carrier restrictions.
- You will provide necessary documentation or assistance required for customs clearance or other regulatory requirements.
- You have obtained consent to provide any third-party personal data (e.g., recipient information) to Us.
- You will not use our facility address to misrepresent ownership, control, or residency.
You agree to indemnify Us for any breach of these warranties.
6. Payments and Fees
You agree to pay all applicable fees for the Services You use, as described on our website, in quotes provided, or upon checkout. Fees may include shipping costs, insurance premiums, consolidation fees, storage fees, special handling charges, return processing fees, duties, taxes, and payment processing fees. All fees are subject to change, though changes typically apply to future transactions.
- Fees for Services are generally earned once the Service is initiated (e.g., package received, consolidation started, shipment processed).
- Payments are typically due before shipment dispatch or service completion unless otherwise agreed.
- All fees are stated in [Specify Currency, e.g., US Dollars]. Currency conversion costs may apply if paying from another currency.
- You must raise any billing disputes within [e.g., 14 days] of the charge appearing on your account.
- Failure to pay may result in suspension of Services, holding of Shipments, or disposal of goods as outlined elsewhere in these Terms or policies.

7. Prohibited Items and Activities
You are strictly prohibited from using the Services to ship items listed in our Prohibited Items Policy or items otherwise restricted by law or Carrier policy. Engaging in fraudulent activities, attempting to circumvent customs regulations, or using the service for illegal purposes is strictly prohibited and will result in account termination and potential legal action. 8. Right to Inspect and Repack
You acknowledge and agree that Shipzen and/or relevant authorities (e.g., customs, security screeners) reserve the right to open and inspect any Shipment tendered to Us, without prior notice, for safety, security, customs, or regulatory compliance purposes. We also reserve the right to repackage items if deemed necessary for safe transport or to comply with Carrier requirements, potentially incurring repackaging fees.
9. Shipping, Customs, and Delivery
Shipzen facilitates shipping via third-party Carriers. Shipping times are estimates and not guaranteed. You are the importer/exporter of record responsible for customs compliance and payment of duties/taxes. Refer to our detailed Shipping Policy for specifics on receiving, storage, shipping process, customs, claims, and undeliverable shipments.
10. Returns
Returns of merchandise must be arranged directly with the original Merchant according to their policy. Shipzen can facilitate the return shipment from our facility under certain conditions. Refer to our detailed Return Policy .
11. Insurance
Basic Carrier liability is often limited. We strongly recommend purchasing additional shipping insurance for valuable items. Insurance is optional and premiums are paid by You. Insurance is typically provided by a third-party insurer and is subject to their terms, conditions, and exclusions. Shipzen facilitates the purchase but is not the insurer. Claims are processed according to the insurer's and Carrier's procedures, as outlined in our Shipping Policy.
12. Intellectual Property
The Services and their original content, features, and functionality are and will remain the exclusive property of Shipzen and its licensors. The Services are protected by copyright, trademark, and other laws. Our trademarks may not be used without prior written consent.
13. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Shipzen MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
IN NO EVENT SHALL Shipzen, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY (INCLUDING CARRIERS) ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (V) DELAYS, LOSS, OR DAMAGE CAUSED BY CARRIERS, CUSTOMS, OR FORCE MAJEURE EVENTS; (VI) YOUR FAILURE TO COMPLY WITH THESE TERMS OR APPLICABLE LAWS.
OUR MAXIMUM AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES (INCLUDING CLAIMS FOR LOSS OR DAMAGE TO SHIPMENTS) IS LIMITED TO THE LESSER OF (A) THE AMOUNT OF FEES PAID BY YOU TO Shipzen FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, (B) THE DECLARED VALUE FOR CARRIAGE OF THE SHIPMENT, OR (C) USD $100 (ONE HUNDRED US DOLLARS), UNLESS ADDITIONAL INSURANCE COVERING A HIGHER VALUE WAS PURCHASED THROUGH US AND THE CLAIM IS APPROVED BY THE INSURER/CARRIER. LIABILITY IS LIMITED STRICTLY TO DIRECT LOSS AND DAMAGE; ALL OTHER TYPES OF LOSS OR DAMAGE ARE EXCLUDED.
We are not liable for loss or damage arising from inadequate packing, inherent vice of the goods, fragile items not properly declared or packed, or items on the Prohibited Items list.
14. Indemnification
You agree to defend, indemnify and hold harmless Shipzen and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service; b) your breach of these Terms or any incorporated policy; c) content or items shipped through the Service, including any violation of laws, regulations, customs requirements, or third-party rights (including intellectual property rights).
15. Force Majeure
Shipzen shall not be liable for any failure or delay in performance under these Terms resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials, or failures of telecommunications or transportation infrastructure ("Force Majeure Event").
16. Dispute Resolution & Governing Law
These Terms shall be governed and construed in accordance with the laws of [Your State/Country, e.g., California, USA], without regard to its conflict of law provisions.
You agree to first attempt to resolve any dispute arising out of or relating to these Terms or the Services by contacting Shipzen Customer Support. If the dispute cannot be resolved informally within [e.g., 30 days], You agree that any legal suit, action, or proceeding shall be instituted exclusively in the federal or state courts located in [Your City, State/Country, e.g., San Francisco, California]. You waive any objection to venue or inconvenient forum.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
18. Variation / Amendments
We reserve the right, at our sole discretion, to modify or replace these Terms at any time by posting the updated terms on the website. We will update the "Last updated" date. If a revision is material (as determined in our sole discretion), we may provide additional notice (e.g., via email or account notification). What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
